1.- INTRODUCTION

In its commitment to promoting the development of the entrepreneurial ecosystem in the Valencian Community, the Valencian Startup Association (hereinafter “Startup Valencia”), launches Capital4Startups Pitch Day, in collaboration with its partners in the framework of Digital Summit 2021.

The objective of this initiative is to expose entrepreneurial talent to the local, national and international investment community, promote contact between both groups for potential investment, commercial or strategic agreements and empower startups that participate in the event.

Startup Valencia’s partners, the funds and investors within the Capital4Startups initiative as well as the main investors of the national ecosystem, will be invited to the event.

2.- PURPOSE

The purpose of this call is to select startups to pitch during the event taking place on June 22, 2021 in-person or online format pending determination based on the evolution of restrictions due to the current health crisis.

The projects will be selected based on criteria such as the innovative proposal, its viability, scalability, equipment and interest for potential investors.

The jury will choose among the finalists, two winning startups that will have the opportunity to participate in Digital Summit 2021.

3.- REQUIREMENTS

This initiative is aimed at early stage startups (hereinafter “Seed”) and growth stage startups (hereinafter “Growth”), regardless of geographic location. The call is open to all those entrepreneurs, whether individuals or legal persons, of legal age, whatever their nationality, who are in search of financing from private investors.

4.- SUBMISSION OF APPLICATIONS

4.1. The mere participation in the conference implies acceptance of the full content of these Terms and Conditions. The non-acceptance of any of the points implies the non-participation in the call and, in case of being selected and / or awarded, the automatic waiver of the prize.

4.2. Applications must be submitted via the online registration form available on the designated website https://opencalls.valenciadigitalsummit.com/2021.

4.3. Applicants will be liable towards Startup Valencia for the veracity of the data communicated, ensuring that they correspond to his person and not to that of a third party.

5.- PHASES

APPLICATIONS (10-31/May): The project submission period will begin on May 10, 2021 and end at 23:59h on May 31, 2021.

SELECTION (1-15/June): The projects presented will be evaluated and up to a maximum of ten startups will be selected in order of score, being able to separate between the Seed and / or Growth categories. The list of selected candidates will be announced before June 15, 2021, notifying the selected participants individually by email, making it public on social networks and the media.

PRESENTATIONS (22/June): The selected applicants will present their pitch during the event scheduled on June 22, 2021, which will be open to the main investors and funds of the national ecosystem. Presentations may be accompanied by visual support and will last a maximum of 5 minutes, which may be followed by a question time from investors.

DIGITAL SUMMIT (15-16/December): Two winning startups will have the opportunity to participate in Digital Summit 2021 at the City of Arts and Sciences in Valencia.

6. EVALUATION CRITERIA

Startup Valencia will appoint a jury that will be made up of professionals with recognized experience and prestige in the sector.

The selection criteria that will be used to select the finalists and winning startups is:

  • Invertible, an interesting proposal for investors, financial institutions and / or companies.
  • Viability, technically and commercially viable projects.
  • Scalability, potential for internationalization and application in other countries.
  • Team, relevant experience and commitment to the development and launch of your proposal.
  • Innovation, relevant and differential innovative aspects.

7.- TERMS AND CONDITIONS ACCEPTANCE

In order to respect the different initiatives and business projects participating in the call, selected applicants undertake to send the required documentation as well as to participate in the event on June 22, 2021 at the time they are assigned.

Startup Valencia reserves the right, unilaterally and without prior notice, to exclude any participant, especially in those cases in which it has suspicions or it is detected that it is trying to defraud, alter and / or disable, directly or indirectly, the proper functioning and the normal and regulatory course of this initiative.

The selection committee and jury will have the capacity to interpret and complete the Bases of this initiative and its decisions will be final and irrevocable.

The non-acceptance of any of the terms and conditions of the legal bases of this initiative will also mean the loss for the participant of the right to obtain any prize that could be derived from their participation in this Promotion.

The mere participation in the call indicates the acceptance of the entire content of these Terms and Conditions. The non-acceptance of any of the points that make up these Bases implies the non-participation in the call and, in case of being selected and / or awarded, the automatic waiver of the prize.

8.- INTELLECTUAL PROPERTY RIGHTS

The applicants selected to participate at the conference declare to have sufficient titles on the industrial property rights (brands, business ideas, logos, commercial name…) included in their proposals, stating through the acceptance of these bases, no infringement of any intellectual property right or any other right that any third party in Spain or abroad may have on the contents, and exempting Startup Valencia from any responsibility related to the use of the aforementioned programs and / or contents.

Specifically, and in relation to the content and images that the participants make public during the initiative, they guarantee and are liable towards Startup Valencia as well as third parties for the following aspects:

That they are the owners or legitimate owners of the rights that allow Startup Valencia to be granted the license for its publication and that, where appropriate, they have obtained the necessary consent to do so from third parties.

That they do not violate applicable laws such as those relating to the right to privacy, image and / or honor, intellectual property rights, industrial property or similar, as well as any right of a third party, whether a person or entity.

That in the hypothetical case that personal data of another person is published during the course of the Competition, they have previously informed and obtained their consent for their publication.

Therefore, the participant will be liable towards Startup Valencia for the veracity of the data communicated, ensuring that they effectively correspond to his person and not to that of a third party, holding Startup Valencia harmless from any demand or claim that, in his In this case, it could be presented by third parties in relation to the above statements, as well as any legitimate right over the content that has been published and / or provided to Startup Valencia within the framework of the initiative.

In any case, the participants assume under their sole responsibility the consequences of damages or actions that derive from the use of the contents and / or programs included in their proposals, as well as their reproduction or dissemination.

The intellectual and / or industrial property of the initiatives and projects presented at the conference will belong – if applicable in each case – exclusively to the participants who have presented them.

9.- CONFIDENTIALITY AND DISCLOSURE OBLIGATIONS

Confidentiality will be guaranteed for the ideas and / or projects presented by the participants at the event. The organizers may only promote -at any time and through any means- general characteristics of the projects involved, including the names of the ideas and / or projects, participants, and especially of those who win.

10.- ADVERTISEMENT

Within the acceptance of these rules, applicants, especially the winners, expressly authorize Startup Valencia without territorial or term limit, to fix, reproduce, disseminate and use by all written and spoken means and signed, in any form by any means and on any medium, your name, image and voice, and the general characteristics and the name of the ideas or projects presented, respecting in any case what is established in the sections of Intellectual Property and Confidentiality of this document, provided that the purposes are advertising, informative and / or promotional relating to the day or Startup Valencia without the right to any compensation.

11.- PRIVACY POLICY, DATA PROTECTION AND COMPLIANCE WITH THE GDPR

In compliance with the current personal data protection regulations, and paying particular attention to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, relating to the protection of natural persons with regard to the processing of personal data and the free circulation of these data, and by which Directive 95/46 / EC is repealed (hereinafter, the “General Protection Regulation of Data “or” RGPD “) and in Law 3/2018, of December 5, Protection of Personal Data and Guarantee of Digital Rights (hereinafter, the” LOPDGDD “), the participants of the conference are informed that the person responsible for the processing of your personal data is Startup Valencia, made up of the Valencian Association of Startups with NIF G98929110 and with registered office at Calle Almirante Cadarso 26 in Valencia.

Startup Valencia will process your personal data collected through the registration or registration forms on the day provided on the website https://opencalls.valenciadigitalsummit.com/2021 in order to manage your participation in the call, as well as to process communication with the winner of the competition and making it possible to deliver the prize and publish their name and image on our website and on any other medium. In the same way, your personal data may be used to manage the delivery of content through the Newsletter service, in the event that you expressly authorize us to do so through the corresponding subscription forms.

The legitimate basis of the treatment is, mainly, the consent of the interested party or participant, granted through the acceptance of these Legal Bases and their registration in the session. You will have the right to revoke the consent granted at any time in a simple and free way by writing to us at hello@startupvalencia.org, although this will not affect the legality of the treatment prior to its withdrawal. In any case, failure to provide the required personal data may lead to the inability to participate in the competition.

The personal data provided to Startup Valencia by the participants must always be true and complete. In the event that they were false, if the prize had been awarded to the participant, Startup Valencia reserves the possibility of denying the right to opt for said prize at any time.

In general, your data will not be transferred to third parties unless established or imposed by law. Notwithstanding the foregoing, your data may be transferred to collaborating entities, promoters, organizers and other participants in the competition (“Partners”) of the day or Startup Valencia for the purpose of promoting your company and contacting you due to the Interest generated as a result of your participation in the competition. In the event that these collaborating entities were located outside the community territory, it would be an international transfer of data, which would be carried out, in any case, with the due legal guarantees in accordance with articles 44 and following of the RGPD.

Likewise, you are informed that, by virtue of article 30 of the Spanish Commercial Code, your data may be kept for at least six (6) years.

Finally, you are informed that you may exercise your rights of access, rectification, deletion, limitation of treatment, data portability, opposition and, where appropriate, not to be the subject of a decision based solely on automated processing, including the elaboration of profiles, directing a written communication through the email hello@startupvalencia.org, with the Ref. “Exercise Rights” accompanying your request, if necessary, a copy of your national identity document or identification document equivalent (passport, NIE….). If you do not consider your personal rights duly attended, you may file a claim with the competent control authority, in this case, the Spanish Data Protection Agency.

12.- MODIFICATIONS AND WITHDRAWALS

Startup Valencia reserves the right to modify these rules at any time, including the award and / or its possible cancellation before the scheduled resolution date, provided there is just cause, committing to publish such modification through its website.

Likewise, in case the participants wish to make any type of modification or cancellation related to the information provided, they must do so by email to the address hello@startupvalencia.org.

13.- GOVERNING LAW AND JURISDICTION

These terms of participation are subject to the material laws of Spain. The place of jurisdiction for any and all legal disputes arising from or otherwise related to these terms is Valencia.
