In compliance with the Personal Data Protection regulations and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD) and with the Organic Law 3/2018, of December 5, on the protection of personal data and guarantee of digital rights (LOPDGDD), then VALENCIA STARTUP ASSOCIATION (AVS) provides you with the information so that you are aware of all the elements relevant to the processing of your data.

2. When do we collect your personal data?

Your personal data may be collected at the following times:

– Through contact form/s and/or registration: our website has different forms that request different data for different purposes, for example, contacting us, joining a certain project, registering for an event, among others.
– Through Cookies: our website installs cookies that collect information about navigation, we recommend that you read the cookies policy for complete information about it.

3. For what purposes and on what grounds do we process your data?

1. Your data will be processed to assist, manage and respond to possible requests, comments and/or queries. The processing may be carried out on the basis of your consent to send us your query and/or request (article 6.1.a) RGPD); and/or on the basis of the execution of a contractual relationship and/or request for possible pre-contractual measures (article 6.1.b) RGPD).

2. Provided that you have accepted, to keep you informed about services, promotions and products related to our activity through the means that you have provided us (telephone, mail, email, SMS and / or messaging system, among others) that may be of interest to you. The processing is carried out on the basis of your consent to subscribe to the service of sending promotional communications (article 6.1.a) RGPD).

3. When you register as a partner to our services, we will process your personal information to manage your registration, including the subsequent assistance, management and care as a partner, as well as the management of payments. The processing is necessary for the performance of a contractual relationship to which you are a party and/or request for possible pre-contractual measures (article 6.1.b) RGPD).

4. Whenever you have registered for an event, online or offline, your personal data will be used to organize and manage your attendance at the event. The processing is carried out on the basis of your consent when you register for a particular event (Article 6.1.a) GDPR).

5. If you have registered for an AVS project, your personal data will be processed to manage your participation in the project you have registered for. The processing is carried out on the basis of your consent when you register for a given project (Article 6.1.a) GDPR).

6. Your data will be processed in order to carry out debt collection actions in case of non-payment of membership fees. This implies that the data relating to the debt may be communicated to third party companies duly authorized by law and responsible for managing the default of monetary obligations. The processing is necessary for the execution of a contractual relationship to which you are a party (article 6.1.b) RGPD).

7. The information will be treated to comply with our legal obligations, possible judicial resolutions and other decisions determined by the authorities. Including the communication of your personal data to law enforcement agencies, whenever we have suspicions or indications of an action that may constitute an unlawful / criminal offense. The basis for the processing is the fulfillment of our legal obligations (article 6.1.c) RGPD).

8. We will process your information to perform statistical analysis anonymously for the purpose of knowing the performance of our product and / or service, in order to improve the development and customization of our services. The processing is carried out for the satisfaction of our legitimate interest, which is to manage and improve our products and services (article 6.1.f) RGPD). Always taking into account that our interest does not prevail over your interests, rights and fundamental freedoms.

9. When competitions and awards are launched for StartUps, your personal data will be processed for the purpose of managing and enforcing your participation. The processing is carried out on the basis of your consent when you register for the contest (Article 6.1.a) GDPR).
If you have enrolled in any of the following AVS initiatives or projects, you will be interested to know the following particularities, without prejudice to what is specified in the documents specific to such projects or initiatives, regarding the processing of your personal data:

Valencian Region Startup Observatory Project If you have registered for this project, your personal data will be processed in order to create a directory of StartUps. For this purpose, you will have to fill in a form with certain personal data. However, such personal data will only be processed for the purpose of managing your participation in the project and will not be published in the directory. Only non-personal information will be published in the directory.

Valencian Community Industry Digitalization Project. Provided that you have registered for the project, your personal data will be processed in order to put you in contact with industrial sectors that may be of interest to your Startup. For this purpose, you must fill out a specific form for this project, whose information will be processed for the purpose of managing your participation in the project.
The information will be processed in order to manage your participation in the project, and your data will be communicated to the General Directorate of Industry, Energy and Mines of the Generalitat Valenciana.

4. How long will we keep your personal data?

Your personal data will be processed for the period necessary to fulfill the purposes set out in this Privacy Policy, as well as to retain your personal information in compliance with the provisions of the relevant laws and regulations, especially in relation to the statutory limitation periods, and for the formulation, exercise or defense of claims.

The criteria we follow for this is determined by (a) the purpose of the data collected and the fulfillment of that purpose (e.g. for the duration of our relationship); (b) the reasons for which the data is collected (e.g. in case of consent, you may revoke your consent at any time) and, (c) mandatory storage periods according to contractual and regulatory requirements.

Please note that, in some cases, we may retain your data for the period necessary for the formulation, exercise or defense of claims, requirements, liabilities and legal and / or contractual obligations, always being duly blocked.

5. To which recipients can your data be communicated?

Your personal information will not be disclosed to third parties without your express consent. However, depending on the purposes for which the personal information is collected, such information may be accessed, without distinction, by the following third parties:

– Employees and/or collaborators authorized by AVS, always subject to the applicable data protection regulations.

– Agencies and / or competent authorities and the relevant law enforcement agencies, in cases where there is a requirement, a legal obligation or we consider that there are sufficient indications and / or suspicions to be before an illicit or criminal offense.

– Third-party service providers that process information as data processors. All our suppliers have signed the corresponding data processing contract in accordance with the personal data protection regulations.

– In the event of non-payment of the membership fee, the debt may be communicated to third party companies duly authorized by law and in charge of managing the non-payment of monetary obligations.

– When competitions and awards are launched for StartUps, your information may be communicated to those third parties (e.g. municipalities) that are necessary to manage and enforce your participation.

We inform you that AVS does not transfer your personal data to a country outside the European Economic Area (E.E.A.). However, if we do so, we will ensure that we have adequate protection of your personal data by using the safeguards permitted by law, in particular the use of the standard contractual clauses approved by the European Commission.

6. What are your rights when you provide us with personal data?

If we process your data you should know that your rights are:

– Right to request access to personal data: you can ask if AVS is processing your data, and if so, you can access them.
– Right to request rectification if the data is inaccurate, or complete the data that we have incomplete.
– Right to request the deletion of your data.
– Right to request the limitation of their treatment: in this case, AVS will only keep them for the exercise or defense of claims.
– Right to object to the processing: we will stop processing the personal data, with the exception that they must continue to be processed for legitimate reasons or for the exercise or defense of possible claims.
– Right to data portability: in case you want your data to be processed by another data controller, we will facilitate the transfer of your data to the new controller, provided that it is technically possible.
– Right not to be subject to a decision based solely on the automated processing of your personal data.

If you have given us your consent for any specific purpose, you may withdraw your consent at any time without affecting the lawfulness of the processing based on the consent prior to withdrawal.

Whenever you consider it appropriate, you may file a complaint with the competent authority, in this case, the Spanish Data Protection Agency (https://www.aepd.es).

7. Modifications

We will only use your personal data as set out in this Privacy Policy which is in force at the time we collect your information. In the event that AVS makes a change to the processing of your data, we will inform you in a timely manner.

8. Additional information

– Policy on children’s use. Our services are directed exclusively to persons of legal age. In this sense, we do not deliberately collect information from minors. In any case, if you are a parent or legal guardian and you believe that your children or guardians have submitted personal information to us, please contact us by sending an email to hello@startupvalencia.org.

– Specially protected data. AVS does not collect or process personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data intended to uniquely identify a natural person, data concerning health or sex life or sexual orientations.

– Links. The AVS website may contain links to other websites that we believe may be potentially useful and informative to you. However, please be aware that we do not endorse or recommend the content or services of such websites, nor are we responsible for the privacy policies of such websites. We encourage you to be aware of and read the privacy policies of every site you visit. Please remember that this Privacy Policy applies only to data collected and/or processed by AVS.
